New York has taken a pioneering step as the first U.S. state to implement a temporary halt on the establishment of new large-scale data centers designed for artificial intelligence systems. Governor Kathy Hochul has enacted an executive order that pauses the state permitting process for any new “hyperscale” data centers boasting an electrical capacity surpassing 50 megawatts. This initiative responds to rising concerns over energy costs, environmental consequences, and the strain on natural resources.
Governor Hochul emphasized the need for this moratorium to allow state regulators the opportunity to formulate more stringent standards addressing energy consumption, water utilization, environmental conservation, and the implications of data centers on local communities. She pointed out that unchecked expansion of data centers could lead to increased utility bills, overburdened energy infrastructure, and depletion of essential resources such as water. The moratorium is set to last for up to one year, during which a new regulatory framework will be developed.
In addition to the moratorium, New York is contemplating measures that would require sizeable data centers to either produce their own energy or face elevated energy costs. This strategy aims to prevent the additional financial burden from being transferred to residents. The move comes amidst growing public concern in the U.S. about the expansion of AI-related infrastructure, with several states considering restrictions due to fears of higher electricity prices, environmental harm, and land use issues.
Governor Hochul also highlighted that future data centers should only be constructed in communities that are supportive of such projects, ensuring adherence to local zoning regulations. Furthermore, the state is committed to making sure that communities hosting these major facilities benefit economically. This executive order is part of a broader movement in New York to regulate AI infrastructure, coinciding with ongoing legislative discussions about enhancing transparency, energy efficiency, and environmental safeguards.
